Stichting (foundation) Amsterdam Light Festival - October 2022
These Terms and Conditions Ticketshop are applicable after purchasing a ticket for Amsterdam Light Festival Edition 11 purchased via the Amsterdam Light Festival ticketshop.
Article 1 Definitions
In these Terms and Conditions Ticketshop (TCT), the following capitalised terms always have the following meaning:
Admission Ticket
Specified receipt (including the relevant product from the ALF Ticketshop) with which a Ticket Buyer has access to an Event;
Agreement
The purchase of an Admission Ticket via the ALF Ticketshop;
ALF
Stichting (foundation) Amsterdam Light Festival, with its registered office and principal place of business at (1018 XA), in Amsterdam at Weesperplein 4A and registered in the Trade Register of the Dutch Chamber of Commerce under number 52374858;
ALF Ticketshop
The ticketshop on the Website which is managed by CM.com and Prioticket.com on behalf of ALF and in which purchases are made by Ticket Buyers;
Boat Product
The boat experience that takes place during the Festival on a specific date and time slot for which an Admission Ticket must be purchased via the ALF Ticketshop on the Website;
Boat Admission Ticket
Specified receipt (including the relevant Boat Product from the ALF Ticketshop) with which a Ticket Buyer has access to a Festival Activity;
Cardholder
The natural person who has access to a Festival Activity with the Admission Ticket;
CM.com
CM.COM Netherlands B.V., the third party that manages the ALF Ticketshop for Walking Products on the Website on behalf of ALF;
Customer Service
Customer service for questions about the purchase process and changes to personal data of Boat Tickets as well as general questions;
Customer Service Walking
Customer service for questions about the purchase process and changes to personal data of Walking Tickets on the CM.com platform;
Festival
The Amsterdam Light Festival Edition #11 that takes place during the Festival Period and for which you can buy an Admission Ticket in the ALF Ticketshop;
Festival Activity
An activity organised by ALF that takes place during the Festival Period;
Festival Period
The period from December 1, 2022 to January 22, 2023 during which the Festival takes place;
Prioticket
Prioticket B.V., the third party that manages the ALF Ticketshop for Boat Products on the Website on behalf of ALF;
Privacy Statement
The Privacy & Cookies statement of ALF, which can be found on the Website;
Shipowners
Third parties with which ALF collaborates and who carry out the various Boat Products during the Festival Period;
Terms and Conditions Ticketshop
These terms and conditions of Amsterdam Light Festival Edition #11;
Ticket Buyer
The natural and/or legal person who purchases an Admission Ticket;
Voucher
A digital voucher to be exchanged for an Admission Ticket;
Walking Admission Ticket
Specified receipt (including the relevant Walking product from the ALF Ticketshop) with which a Ticket Buyer has access to a Festival Activity (a walk);
Walking Product
The walking experience that takes place during the Festival for which an Admission Ticket must be purchased via the ALF Ticketshop on the Website. The Walking Product is valid for 48 hours after activation;
Website
The ALF website on which the Admission Ticket is offered in the ALF Ticketshop.
Article 2 Applicability
2.1 These TCT apply to every Agreement.
2.2 ALF can always change and/or supplement these TCT. Changes do not apply to Agreements already concluded. The most current TCT can be found on the Website. If the Ticket Buyer does not agree with the amended and/or supplemented TCT, the Ticket Buyer is free to not purchase an Admission Ticket via the Website.
2.3 In the event of a conflict between the provisions of these TCT and other general terms and conditions, these TCT will prevail.
Article 3 Offer and conclusion of Agreement: General
3.1 ALF organises the Festival. Festival Activities are organised during the Festival for which the Ticket Buyer needs an Admission Ticket. This Admission Ticket can be obtained in two ways: i) by redeeming a Voucher (Article 4); or ii) or by purchase (Articles 5 and 6).
3.2 The Agreement is concluded by going through the ordering and payment process on the Website, including acceptance of these TCT and payment of the Admission Ticket.
3.3 Tickets for the Walking Product (“Walking Admission Ticket”) are valid for the entire Festival Period until activation. Cancellation with a refund of the completed payment is not possible, unless a circumstance as referred to in Article 11 paragraph 3 of these TCT takes place. Any contact details can be changed via the Customer Service Walking.
3.4 It is possible to make changes in date and/or time regarding Admission Tickets for the Boat Product (“Boat Admission Ticket”) 24 hours before the start of the execution thereof. Follow the link in the confirmation email. Refunding of the completed payment is not possible, unless a circumstance as referred to in Article 11 paragraph 3 of these TCT takes place.
3.5 ALF is not bound by obvious errors in the offer on the Website.
Article 4 Conclusion of the Agreement: Voucher
4.1 A natural person/legal person can purchase a Voucher for a Festival Activity via a recognised partner of ALF.
4.2 A natural person/legal person must redeem the Voucher in the ALF Ticketshop for an Admission Ticket.
4.3 The person referred to in Article 4.1 will receive an electronic Admission Ticket via the ALF Ticketshop at the indicated mail address.
4.4 The Voucher can be redeemed once for one or more Admission Tickets. One Admission Ticket provides access to one person.
4.5 For questions about the activation of the Voucher in the ALF Ticket shop, please contact the Customer Service. For all other questions, please contact the recognised partner of ALF as stated on the Voucher itself.
Article 5 Walking Admission Ticket
5.1 Ticket Buyer buys one (or more) Walking Admission Ticket(s) in the ALF Ticketshop. After activation, it is valid for 48 hours during the Festival Period.
5.2 After purchasing a Walking Admission Ticket, the Ticket Buyer will immediately receive an electronic Walking Admission Ticket at the email address specified by him. If the Ticket Buyer has not received an email including the Walking Admission Ticket within a reasonable time after completion of the payment process, the Ticket Buyer can contact Customer Service Walking.
5.3 The Walking Admission Ticket contains a unique link that activates access to the Walking Product.
5.4 The Walking Admission Ticket is issued once and gives access to one person: Cardholder.
5.5 ALF is and remains the owner of the Walking Admission Ticket. Only the holder of the Walking Admission Ticket who is the first to show the Admission Ticket at the start of the relevant Festival Activity will be admitted. ALF may assume that the Cardholder also has the right thereto.
5.6 Without the prior written consent of ALF, Cardholder is not permitted:
a. To resell Walking Admission Tickets to third parties or to provide them to third parties in any other way commercially, directly or indirectly;
b. To offer Walking Admission Tickets in commercial communications - in any way whatsoever - or to refer therein in any other way to the Walking Admission Tickets.
5.7 ALF reserves the right at all times to refuse orders for Walking Admission Tickets by Ticket Buyers if ALF suspects, or if it has become apparent, that these Ticket Buyers are guilty of acts contrary to the provisions of paragraph 6 of this article.
5.8 ALF reserves the right, in the event that a maximum has been set for the number of Admission Tickets for the specific Festival Activity, to cancel Admission Tickets that exceed this maximum on the basis of "last in, first out". Walking Admission Tickets canceled by ALF will in these circumstances be reimbursed to the Ticket Buyer up to the amount that has been paid.
Article 6 Boat Admission Ticket
6.1 Ticket buyer buys one (or more) Boat Admission Ticket in the ALF Ticketshop.
6.2 After purchasing a Boat Admission Ticket, the Ticket Buyer will immediately receive an electronic Boat Admission Ticket to the indicated email address. If the Ticket Buyer has not received an email including the Boat Admission Ticket within a reasonable time after completion of the payment process, the Ticket Buyer can contact the Customer Service.
6.3 Before the Cardholder is granted access to a Boat Product, the Boat Admission Ticket is scanned and verified.
6.3 The Boat Admission Ticket is issued once and gives access to one person: Cardholder.
6.4 ALF is and remains the owner of the Boat Admission Tickets. The Boat Admission Ticket entitles the Cardholder to attend the Festival Activity. Only the holder of the Boat Admission Ticket who shows the Admission Ticket first at the start of the Festival Activity will be granted access. ALF may assume that the Cardholder is also the rightful thereto.
6.5 Without the prior written consent of ALF, the Ticket Buyer is not permitted to:
a. Resell Boat Admission Tickets to third parties or to provide them to third parties in any other way commercially, directly or indirectly;
b. Offer Boat Admission Tickets in commercial communications - in any way whatsoever - or to refer therein in any other way to the Boat Admission Tickets.
6.6 ALF reserves the right at all times to refuse orders for Boat Admission Tickets by Ticket Buyers if ALF suspects, or if it has become apparent, that these Ticket Buyers are guilty of acts contrary to the provisions of paragraph 6 of this article.
6.7 ALF reserves the right, in the event that Festival Activities have a maximum number of Admission Tickets, to cancel Boat Admission Tickets that exceed this maximum on the basis of “last in, first out”. Boat Admission Tickets canceled by ALF will in these circumstances be reimbursed to the Ticket Buyer up to the amount that has been paid.
Article 7 Third parties
7.1 The Shipowners are responsible for the execution of all Boat Products.
7.2 In the event of complaints about the Admission Ticket purchased through the ALF Ticketshop, the Ticket Buyer must contact the Customer Service directly.
7.3 In the event of complaints about (the execution of) the Boat Products, the Ticket Buyer must address the Shipowner directly. The Shipowner - and not ALF - is fully responsible for the execution of the relevant trip.
7.4 If the Ticket Buyer does not agree with the handling of the complaint by the Shipper and/or Customer Service, ALF can mediate and try to solve the problem. If this does not lead to a solution, article 15 paragraph 4 and paragraph 5 of these TCT applies.
Article 8 Information, price & payment
8.1 All information about a Festival Activity and the availability of Tickets for it, which is provided by ALF to the Ticket Buyer, is provided without obligation and subject to change at all times.
8.2 ALF does not guarantee that information on the Website is always correct, actual or complete.
8.3 The price of the Admission Ticket is mentioned on the Website. ALF reserves the right to adjust this amount. The current price is the price that is mentioned on the Website.
8.4 When purchasing an Admission Ticket, the price including VAT will be charged by ALF to the Ticket Buyer. Any additional costs, such as service and payment costs, are mentioned on the Website.
8.5 Payment of the Admission Ticket takes place via the payment methods made available by ALF in the ALF Ticketshop.
Article 9 Rules of conduct and obligations Ticket Buyer
9.1 The Ticket Buyer is obliged to comply with any applicable Dutch RIVM (Rijksinstituut voor Volksgezondheid en Milieu) guidelines regarding the COVID-19 rules.
9.2 During the Festival Activities, the Ticket Buyer is obliged to comply with the instructions of employees of ALF, the Shipowners, and/or other authorised persons.
Article 10 Rights of ALF
10.1 ALF reserves the right at all times to invalidate the Admission Ticket and to refuse Cardholder (further) access to a Festival Activity (without refund of the purchase amount) in the event of violation by the Ticket Buyer and/or Cardholder of (one or more of) the provisions as stated in these TCT and/or the Agreement.
10.2 ALF reserves the right to deny Cardholder (further) access to the Festival Activity if ALF deems this reasonably necessary to maintain (public) order and safety during the Festival Activity. This also does not allow a refund of the purchase price of the Admission Ticket.
10.3 If it is clear that the Admission Ticket has been falsified, ALF is entitled to refuse the holder of this Admission Ticket (further) access to the Festival Activity, without the Ticket Buyer or Cardholder being able to claim any damage suffered as a result.
10.4 ALF reserves the right at all times to make video and/or sound recordings of the Festival Activities. In advance, the Ticket Buyer waives the right to oppose the use of his portrait in the context of the publication and reproduction of the aforementioned recordings.
Article 11 (Partial) Cancellation and force majeure
11.1 The parties mutually declare that they are aware that any rules as a result of the COVID-19 virus may have the consequence that ALF is not able to execute the Festival or not in the intended form or will have to terminate it temporarily or prematurely.
11.2 In case of force majeure, ALF has the right to move the Festival to a later date or to cancel the Festival. Force majeure (in the broad sense of the word) includes: governmental measures as a result of a virus (such as COVID-19), war, danger of war and riots, obstructive measures by both domestic and foreign governments, death of one or more members of the Royal House, strikes, failure of and damage to equipment and operating systems, transport blockage/strike, flood, fire, such bad weather conditions that reasonably prevent the Festival from taking place in the original way, sabotage and in general all unforeseen circumstances both at home and abroad, as a result of which compliance with the Agreement can no longer reasonably be expected of ALF.
11.3 If the Festival is canceled by ALF as a result of or in connection with articles 11.1 and/or 11.2 or if the Festival Period changes, ALF will only refund the purchase amount for Festival Activities that are canceled. ALF will take care of this no later than four weeks after the Festival Period.
11.4 If a booked Boat Product or Walking Product is canceled as a result of third parties, for example due to personnel problems at the executing Shipowner, the Ticket Buyer is not entitled to refund the Admission Ticket. Ticket buyer is entitled to rebook the purchased Admission Ticket via the ALF Ticketshop.
11.5 If PrioTicket and/or CM.com unilaterally terminate its agreement with ALF, ALF is entitled to terminate the Agreement with the Ticket Buyer without refunding any payments already made to ALF.
Article 12 Liability ALF
12.1 Ticket Buyer enters and attends the place where the Festival Activities take place at its own risk. Hence, ALF does not accept any liability for damage caused by said entry and/or damage caused by the performance of the boat trip by Shipowner .
12.2 ALF accepts no liability whatsoever for damage suffered by the Ticket Buyer that is caused by loss or damage to the Admission Ticket for whatever reason. ALF offers the Ticket Buyer the opportunity to request a new Admission Ticket from customer service based on his email address.
12.3 ALF will in no case be obliged to reimburse more than the price paid for the Admission Ticket.
12.4 ALF can never be held liable for damage as a result of force majeure as referred to in Article 11.2 of these TCT.
12.5 ALF accepts no liability whatsoever for the purchase and delivery of Tickets and Vouchers that do not take place in the ALF ticket shop.
Article 13 Personal data
13.1 When visiting the Website and ordering an Admission Ticket, personal data is processed. This (personal) data will be processed in accordance with applicable laws and regulations, including the General Data Protection Regulation and the Privacy Statement.
13.2 CM.com and Prioticket also process (personal) data when ordering an Admission Ticket. For more information about the way in which CM.com and/or Prioticket handle your data, we refer you to the privacy statement of CM.com or the privacy statement of Prioticket.
Article 14 Intellectual property
14.1 All intellectual property rights with regard to the (trade) name of the Amsterdam Light Festival, the logos and the like are vested in ALF. The Ticket Buyer is not permitted to make these publicly available or have them made public or to have them made public, or to reproduce them, or use them in any other way, or to make use of them, without the prior written consent of ALF.
Article 15 Final provisions
15.1 All Agreements between ALF and the Ticket Buyer to which these TCT relate are governed exclusively by Dutch law.
15.2 If any article in these TCT should be invalid or destroyed, the other articles of the TCT will remain valid. ALF will then make an arrangement for the void or destroyed passage that comes closest to ALFs intentions with this TCT.
15.3 The Ticket Buyer may not transfer rights and obligations arising from the Agreement to third parties.
15.4 All disputes that may arise as a result of the Agreement between ALF and the Ticket Buyer or any agreement that may result therefrom will be submitted exclusively to the competent court in Amsterdam.
